HOWDJA LIKE THEM APPLES?

Scamorama happily welcomes "Frank Larzlo", fruit and vegetable exporter, whose scambaiting bore fruit!

Let me explain you how this Mr. Paul story has started.
I work for a fruit and vegetables exporting company in Europe.

This Mr. Paul has sent us once an enquiry and I have sent him a price offer. After a few email exchanges it was clear for me that it was a scammer.

From that moment I have waited a couple of days and sent him an email from my "Franz Larzlo" account, which obvioulsy a fake name :-)
Mr. Paul looked "very interested" and I gave him crazy non sense prices and he kept going on with the story.

The love story was also very funny, once at a certain level "Franz" was attracted to "Mr. Paul" and I couldn't believe that the scammer continued, even saying that he was open for a relantionship....

It is rally umbelieveble what they try just for money....

The very detailed explanation about apples was just a copy/paste from wikipedia...I hope he spent 30 minutes reading it hehehe

Date: Fri, 15 Oct 2010 09:04:50 +0200

Dear Sir,

Below my answers to your questions:

a) Terms of payment?????????

100% in advance or Letter of Credit.

b) Loading system in container and quantity.

We load the goods by containers using the BLT loading system version 2010. The system consists of a prime mover truck (the "tractor") with an integral self-loading and unloading capability, a payload trailer (M1076), and demountable cargo beds, referred to as flatracks.

c) Live experation date.

Shelf life is different from expiration date; the former relates to food quality, the latter to food safety. A product that has passed its shelf life might still be safe, but quality is no longer guaranteed. In most food stores, shelf life is maximized by using stock rotation, which involves moving products with the earliest sell by date to the front of the shelf, meaning that most shoppers will pick them up first and so getting them out of the store. This is important, as some stores can be fined for selling out of date products, and most if not all will have to mark such products down as wasted, leading to a loss of profit. Our goods can be stored for 2 months.

d) Cool room voltage that ywill convey the apples than to Benin

Refrigeration is a process in which work is done to move heat from one location to another. Refrigeration has many applications these include but are not limited to; household refrigerators, industrial freezers, cryogenics, air conditioning, and heat pumps.
Cold is the absence of heat, hence in order to decrease a temperature, one "removes heat", rather than "adding cold." In order to satisfy the Second Law of Thermodynamics, some form of work must be performed to accomplish this. The work is traditionally done by mechanical work but can also be done by magnetism, laser or other means. We recomend to store at +4°C.

e) Confirm if you have supplied any apple to any company in benin or africa before?

Yes we did. As you may know, Africa is the world's second-largest and second most-populous continent, after Asia. At about 30.2 million km2 including adjacent islands, it covers 6% of the Earth's total surface area and 20.4% of the total land area. With a billion people in 61 territories, it accounts for about 14.72% of the world's human population. Such a market offers us a lot of sales possibilities.

g)What is your previous business experience in Africa?

Trade is the voluntary, often asymmetric, exchange of goods, services, or money. Trade is also called commerce or transaction. A mechanism that allows trade is called a market. The original form of trade was barter, the direct exchange of goods and services. This was a good experience for us.

h) Does the apples have all the needed exportation licence and documents from your country?
The apple is the pomaceous fruit of the apple tree, species Malus domestica in the rose family (Rosaceae), and is a perennial. It is one of the most widely cultivated tree fruits, and the most widely known of the many members of genus Malus that are used by humans.
There are more than 7,500 known cultivars of apples, resulting in a range of desired characteristics. Cultivars vary in their yield and the ultimate size of the tree, even when grown on the same rootstock.

Dear Franz,

We are not all that Okay.

The Incident affected one of our client.

We have concluded a meeting with the buying company and they have already confirmed that they are ready to buy and their order has been concluded.

But on Monday, they made us to understand that there are some documents that we musht provide from the Benin health authority for an approval of your products to Benin. We agreed with them that we will do this as to see that you complete the business with your company.

Yesterday, we contacted the Benin ministry of public health and sanitation to know how this can be done. They gave me the formalities and after that I discorvered that the cost is too much for me to bear as I do not have such amount with me right Now.

So I dont know if you can be of any assistance to this so that we can complete this and start the business.

Note, any money that is been spent on this will be deducted before you ship any goods and this will be done from my 1% agreement which I had with the buyer.

I tried my possible best to tell the buyer to do this, but they said that this will be a prove to them that I and your company is able to handel this business.

So confirm if you can be of any financial assistance right now.

The Health authority said that the cost for every documentation is Euro7550.50

Pls I have limited time to email do to other programs at hand. can you call me on telephone right now?

Date: Wed, 27 Oct 2010 14:42:41 +0200

Dear Paul,

Before sending you our contract, I would like to specify some points.

Our apple is the pomaceous fruit of the apple tree, species Malus domestica in the rose family (Rosaceae) and is a perennial. It is one of the most widely cultivated tree fruits, and the most widely known of the many members of genus Malus that are used by humans.
The tree originated in Central Asia, where its wild ancestor is still found today. There are more than 7,500 known cultivars of apples, resulting in a range of desired characteristics. Cultivars vary in their yield and the ultimate size of the tree, even when grown on the same rootstock.

Regarding the contract, in law, a contract is a legally binding agreement between two or more parties which, if it contains the elements of a valid legal agreement, is enforceable by law or by binding arbitration. A legally enforceable contract is an exchange of promises with specific legal remedies for breach. These can include compensatory remedy, whereby the defaulting party is required to pay monies that would otherwise have been exchanged were the contract honoured, or an Equitable remedy such as Specific Performance, in which the person who entered into the contract is required to carry out the specific action they have reneged upon.
Agreement is said to be reached when an offer capable of immediate acceptance is met with a "mirror image" acceptance (i.e., an unqualified acceptance).

The parties must have the necessary capacity to contract and the contract must not be either trifling, indeterminate, impossible, or illegal. Contract law is based on the principle expressed in the Latin phrase pacta sunt servanda (usually translated "agreements are to be kept", but more literally "pacts must be kept"). Breach of contract is recognized by the law and remedies can be provided.

As long as the good or service provided is legal, any oral agreement between two parties can constitute a binding legal contract. The practical limitation to this, however, is that generally only parties to a written agreement have material evidence (the written contract itself) to prove the actual terms uttered at the time the agreement was struck. In daily life, most contracts can be and are made orally, such as purchasing a book or a sandwich. Sometimes written contracts are required by either the parties, or by statutory law within various jurisdiction for certain types of agreement, for example when buying a house[4] or land.
Contract law can be classified, as is habitual in civil law systems, as part of a general law of obligations (along with tort, unjust enrichment or restitution).

According to legal scholar Sir John William Salmond, a contract is "an agreement creating and defining the obligations between two or more parties".
As a means of economic ordering, contract relies on the notion of consensual exchange and has been extensively discussed in broader economic, sociological and anthropological terms (see "Contractual theory", below). In American English, the term extends beyond the legal meaning to encompass a broader category of agreements.

This article mainly concerns contract law in common law jurisdictions (approximately coincident with the English-speaking world and anywhere the British Empire once held sway). Common-law jurisdictions usually offer proceedings in the English language, which has become to an extent a lingua franca of international business. The common law retains a high degree of freedom of contract, with parties largely free to set their own terms, whereas civil-law systems typically apply certain over-arching principles to disputes arising out of contract (see, for example the French Civil Code). It is very common for businesses not located in common-law jurisdictions to opt in to the common law through a Choice of law clause.

However, contract is a form of economic ordering common throughout the world, and different rules apply in jurisdictions applying civil law (derived from Roman law principles), Islamic law, socialist legal systems, and customary or local law.

Awaiting your reply in order to proceed.

Best regards,

Franz Larzlo

Likewise! Great minds think alike :) Do come back!
